1. Who we are and these terms
MTBud is an app made by Axelo, a digital product studio in Brabant, the Netherlands, KvK 42121831, VAT NL005510705B22 (“we”). These terms are an agreement between you and us. By creating an account or using MTBud you accept them, together with our Privacy policy. If you don’t agree, don’t use MTBud.
2. Who can use MTBud
- You are 16 or older.
- You sign in with your own Apple or Google account, keep one MTBud account, and don’t let anyone else use it.
- Your profile is true: your real first name or the name you go by, and an honest riding level.
3. What MTBud is — and isn’t
MTBud is a meeting point. Riders post rides — a park, a day, a time, the levels it is for — and others join or ask to join. That is all we provide.
We are not a tour operator, guide, coach, organiser or bike park, and we are not a party to any ride. A host is a rider like you, not an instructor — MTBud does not make a host responsible for you. We don’t verify anyone’s identity, age, skill, fitness or equipment, and riding levels are what riders say about themselves. Parks are listed for convenience; we don’t run them and say nothing about their opening hours, conditions or safety.
MTBud is free. No money changes hands through it, between you and us or between riders.
4. Riding is at your own risk
Mountain biking can cause serious injury or death. Whether you ride, which trails you take and how you ride them is your decision and your responsibility alone. Before you ride with anyone:
- ride within your level, whatever the ride or the group says;
- wear a helmet and the protection the trail calls for, on a bike in good order;
- follow the park’s rules, signs, tickets and closures;
- carry insurance that covers mountain biking and getting help on the hill;
- meet in a public place, tell someone where you are going, and walk away from any ride that doesn’t feel right.
5. How to behave
On MTBud, in chats and on the trail with people you met here, you don’t:
- harass, threaten, insult or discriminate against anyone;
- post anything sexual, violent, hateful, illegal, or that isn’t yours to post;
- pretend to be someone else, or misstate your level to get into a ride;
- post fake rides, spam, advertising or anything commercial;
- collect other riders’ data, scrape the app, or try to break or overload it;
- use MTBud to arrange anything other than riding together.
Be fair to the people you ride with: show up when you joined, and leave or cancel in the app in time if you can’t.
6. Your content
What you post — your profile, ride notes, request messages and chat messages — stays yours. You give us a free, non-exclusive licence to store it and show it to other riders as the app works, for as long as it is on MTBud, including chat messages and hosted rides that remain as “Deleted user” after you delete your account. You are responsible for what you post.
7. Reports, blocks and removal
Block anyone you don’t want to ride with, and report anything that breaks these terms. We review reports by hand.
We may remove content or close an account that breaks these terms or puts others at risk — without notice where safety requires it. If you think we got it wrong, write to hello@axelo.nl.
8. The service
We work to keep MTBud running and useful, but we provide it as it is and as available. Features, parks and these terms may change, and the app may be unavailable at times. We may stop MTBud altogether; if we do, we will tell you in advance where we can.
9. Our liability
We are responsible for MTBud itself — not for rides, which we are not part of, nor for what other riders or parks do, say or post. The risks of riding are yours, as described above.
Where we are liable for damage other than personal injury, our liability is limited to the direct damage you suffer, and to no more than €100 in total. This limit never applies to death or personal injury caused by us, to damage caused by our intent or gross negligence, or where mandatory consumer law gives you more.
10. Ending your account
You can stop using MTBud and delete your account at any time in the app (Profile → Delete account). What happens to your data then is in our Privacy policy.
11. Apple and Google
These terms are between you and us, not Apple or Google. They are not responsible for MTBud, its content, maintenance or support, or for any claim about it. If you got MTBud from the App Store, Apple’s standard Licensed Application End User License Agreement applies as well, and Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Law and disputes
Dutch law applies to these terms. Write to hello@axelo.nl first — most things are sorted out that way. Otherwise, disputes go to the competent court in the Netherlands. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory law of your country and can also go to the courts there.
13. Changes and contact
When we change these terms we update the date above and post a notice on this site before an important change takes effect. If you don’t agree with a change, you can delete your account before it applies; if you keep using MTBud after that, the new terms apply. Questions: hello@axelo.nl.
